What is Bail?
Bail is the amount of money required by a judge or magistrate to obtain a defendant’s release from jail. When bail is posted, it acts as a financial guarantee for the defendant’s appearance to each of their hearings. The defendant is also required to abide by specific Conditions of Release. Common Conditions of Release include some or all of the following:
- Must attend all of their hearings
- Not allowed to leave the State
- Can’t come in contact with the victim
- Not permitted to drink alcohol or use drugs without a prescription
- Must submit to periodic drug testing
- Not allowed to possess a weapon
A violation of the defendant’s Conditions of Release can lead to their reincarceration and or forfeiture of bail.
Bail can be posted as cash at the court or at the jail. Alternatively, you may use a bail bondsman to post a bond with the court; this is called a bail bond, also known as a surety bond, or paper bond.

Maricopa County Jail - Intake, Transfer & Release
Maricopa County's Intake, Transfer, and Release (ITR) jail is a 190,000 square foot facility that was opened in 2020. ITR performs all of the intake and booking processes for new arrests and self-surrender detainees. The facility has four courtrooms to conduct the Initial Appearance of the inmates. There is an attached 512-bed facility that temporarily serves as a housing unit until the inmate is processed. The housing unit can also provide any medical or mental health needs that an inmate may have while being processed. After an inmate is booked and goes to their Initial Appearance, they will be sent to one of the general population facilities (4th Ave Jail, Estrella Jail, Lower Buckeye Jail, Watkins Jail, or Towers jail).
The Intake, Transfer and Release Jail has a “Transportation Hub” for the coordinated transport of defendants into and out of custody. All inmates being released from custody will be transported from their housing unit to the ITR for release processing. If a bond can be posted while an inmate is still at ITR and before they are transported to general population, they will generally be released within a few hours. Once the are transported to a general population facility release times are approximately 24 hours.
